Please read these Terms of Use (“Terms”, “Terms and Conditions”) carefully before using the https://racexr.com website (the “Service”), operated by Braun Holdings, Inc. dba RACEXR (“RACEXR”, “we”, “us”, or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.
All content made available through the Service—including but not limited to live and archived video streams, audio, broadcasts, timing and scoring data, telemetry, statistics, graphics, images, text, replays, logos, trademarks, and metadata (collectively, the “Content”)—is the exclusive property of RACEXR or its licensors and is protected by U.S. and international copyright, trademark, and broadcast laws.
RACEXR retains exclusive worldwide rights to produce, distribute, transmit, rebroadcast, delay, archive, license, and monetize the Content.
Access to the Service does not grant you ownership or any license beyond limited personal viewing rights expressly provided in these Terms.
RACEXR grants you a limited, non-exclusive, non-transferable, revocable license to access and view the Content solely for private, non-commercial, personal use and strictly in accordance with these Terms.
Unless expressly authorized in writing by RACEXR, you may not, directly or indirectly:
Broadcast, restream, retransmit, transmit, distribute, or publicly perform any Content
Screen-capture, record, mirror, embed, or relay Content via OBS, HDMI capture, Discord, social media, streaming software, or similar tools
Create clips, highlights, replays, derivatives, or altered versions of the Content
Share login credentials or allow others to access your account
Circumvent DRM, security controls, watermarking, device limits, or access restrictions
Display Content in bars, restaurants, racetracks, clubs, venues, watch parties, or public events
Use Content in connection with sponsorships, promotions, advertising, or commercial activity
Any unauthorized use constitutes material breach and willful infringement.
Each Subscription permits one (1) concurrent stream per account.
You may not:
Stream on multiple devices at the same time
Share your account with any other person or entity
Allow others to watch using your login
RACEXR may:
Monitor concurrent usage, IP addresses, and device identifiers
Automatically interrupt, suspend, or terminate streams exceeding limits
Permanently revoke accounts engaged in account sharing
No refunds will be issued for enforcement action related to misuse.
You acknowledge and agree that RACEXR may:
Monitor account activity and usage patterns
Employ watermarking, fingerprinting, session tracking, and anti-piracy tools
Disable streams or accounts suspected of prohibited activity
Cooperate with rights holders, promoters, venues, and law enforcement
Violations may result in immediate termination, loss of access, and legal action.
You acknowledge that unauthorized broadcasting or public exhibition causes irreparable harm that is difficult to quantify.
Accordingly, you agree that RACEXR may seek liquidated damages, injunctive relief, statutory damages, attorneys’ fees, and all available remedies under applicable law.
You agree that any violation of these Terms involving broadcast rights, IP infringement, restreaming, or public exhibition entitles RACEXR to immediate injunctive relief, without the requirement to post a bond or prove actual damages.
Subscriptions are valid only for private, personal viewing.
No license is granted for:
Bars, restaurants, racetracks, casinos, theaters, clubs
Public watch parties or ticketed events
Commercial or promotional use
Commercial or venue use requires a separate written license agreement with RACEXR.
Unauthorized venue use is grounds for enforcement and damages.
Subscriptions are billed in advance on a monthly or annual basis. Subscriptions automatically renew unless canceled prior to renewal.
A valid payment method is required. You authorize RACEXR to charge your payment method for all fees incurred.
Failed payments may result in access suspension until resolved.
RACEXR may modify Subscription fees with reasonable prior notice. Continued use after a fee change constitutes acceptance.
All sales are final unless otherwise required by law. Refunds, if any, are granted solely at RACEXR’s discretion.
You must be at least 18 years old. You are responsible for all activity under your account and for safeguarding your credentials.
RACEXR reserves the right to terminate accounts with inaccurate, misleading, abusive, or infringing use.
RACEXR complies with the Digital Millennium Copyright Act (DMCA) and may issue takedown notices, suspend access, or terminate accounts for repeat infringement.
RACEXR may terminate or suspend access immediately for any violation of these Terms.
Surviving provisions include ownership rights, IP protections, indemnification, limitations of liability, and enforcement rights.
These Terms shall be governed by the laws of the State of Minnesota, without regard to conflict of law rules.
We may update these Terms at any time. Material changes will be provided with at least 30 days’ notice. Continued use constitutes acceptance.
