These Terms of Use ("Terms") govern your access to and use of the https://racexr.com website and all related apps and services (the "Service"), operated by Braun Holdings, Inc. dba RACEXR ("RACEXR," "we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.
1. ACCEPTANCE & ELIGIBILITY
You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal authority to agree to these Terms.
2. OWNERSHIP, INTELLECTUAL PROPERTY & BROADCAST RIGHTS
All content available through the Service—including but not limited to live and archived video streams, audio, broadcasts, timing and scoring data, telemetry, graphics, text, images, logos, trademarks, and metadata (collectively, the "Content")—is the exclusive property of RACEXR or its licensors and is protected by U.S. and international copyright, trademark, and broadcast law.
RACEXR retains exclusive worldwide broadcast, streaming, reproduction, and distribution rights to the Content. No ownership rights are transferred to you.
3. LIMITED LICENSE (PERSONAL USE ONLY)
RACEXR grants you a limited, non-exclusive, non-transferable, revocable license to access and view the Service solely for personal, private, non-commercial use, subject to these Terms.
4. PROHIBITED ACTIVITY (ZERO-TOLERANCE)
Unless expressly authorized in writing by RACEXR, you may not:
Broadcast, restream, retransmit, or distribute the Service or Content. Record, screen capture, mirror, embed, or reproduce Content. Create clips, highlights, or derivative works. Use the Service for commercial purposes or public exhibition. Display the Service in bars, venues, racetracks, watch parties, or paid events. Circumvent DRM, security features, device limits, or access controls. Share login credentials or allow third-party access.
Any violation constitutes a material breach and may result in termination without refund and legal action.
5. ONE STREAM PER USER (CONCURRENT USE POLICY)
Each subscription permits one (1) concurrent stream per account. You may not stream on more than one device simultaneously or share or resell your account. RACEXR reserves the right to monitor usage and terminate streams or accounts that exceed authorized use.
6. MONITORING & ENFORCEMENT
RACEXR may monitor account activity, device identifiers, IP addresses, and session data to enforce these Terms and prevent misuse. We may suspend or terminate access immediately for suspected or confirmed violations.
7. COMMERCIAL VIEWING & VENUE USE
Subscriptions are valid for private, personal viewing only. Commercial or public exhibition requires a separate written licensing agreement with RACEXR. Unauthorized venue use is strictly prohibited.
8. SUBSCRIPTIONS, BILLING & AUTHORIZATION
Subscriptions are billed on a recurring basis (monthly or annual) and automatically renew unless canceled prior to renewal. By purchasing a subscription, you authorize RACEXR to charge your payment method on a recurring basis until cancellation is properly completed.
9. CANCELLATION RESPONSIBILITY
You are solely responsible for canceling your subscription before the renewal date through the original purchase platform. Website purchases: cancel at racexr.com. App store purchases: cancel through Apple, Google, Roku, or Amazon. RACEXR cannot cancel third-party app store subscriptions on your behalf.
10. NO REFUNDS
All subscription charges are final and non-refundable, except as required by law. No refunds will be issued for failure to cancel, partial use or unused time, or enforcement/termination due to Terms violations.
11. CHARGEBACKS & DISPUTES
You agree not to initiate a chargeback or payment dispute for authorized charges resulting from your subscription. RACEXR may submit this Agreement, usage records, account data, and access logs as evidence. Improper chargebacks may result in account termination and future purchase bans.
12. INJUNCTIVE RELIEF & DAMAGES
Unauthorized broadcasting, restreaming, or commercial use causes irreparable harm. You agree that RACEXR is entitled to immediate injunctive relief without bond, as well as all available damages, costs, and attorneys' fees.
13. TERMINATION
RACEXR may suspend or terminate access immediately for any violation of these Terms. Provisions relating to ownership, IP protection, enforcement, billing, and liability survive termination.
14. GOVERNING LAW
These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles.
15. CHANGES TO TERMS
RACEXR reserves the right to update these Terms at any time. Material changes will be posted on the Service. Continued use constitutes acceptance.
